Terms of Service - Technical Services

1. Service Warranty

A 1-year warranty applies to all technical services, beginning on the invoice date. The warranty covers defects in workmanship and materials (if materials are provided by Phos Industries LLC). On a valid claim, Phos Industries LLC will, at its option, repair the defect or re-perform the affected service within a reasonable time. This is the customer's exclusive remedy. 2. Claim Process

Warranty claims must be submitted in writing to warranty@phos-ind.com and must be:

  • Submitted within the 1-year warranty period
  • Accompanied by supporting evidence (documentation, photographs, or other relevant proof)
  • Clearly describe the defect and its connection to the original service

3. Exclusions

The warranty excludes:

  • Damage from improper use, neglect, or unauthorized alterations
  • Normal deterioration
  • Failures of client-supplied materials or equipment
  • Damage from circumstances outside Phos Industries LLC's reasonable control
  • Consequential, incidental, or indirect damages

This warranty is the exclusive remedy and is provided in lieu of all other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law. Phos Industries LLC's total liability arising from or related to any service is limited to the amount paid by the customer for the specific service giving rise to the claim.

Terms of Service - Subscription Renewal

1. Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel it at least 15 days before the next billing date. At least 7 days before each renewal, we will email the address on file a reminder that includes the renewal date, the amount to be charged, and instructions for cancellation.

2. Cancellation

To prevent automatic renewal:

  • Cancel your subscription at least 15 days before the next billing date
  • Cancellation requests must be submitted through your account settings or by contacting customer support
  • Once canceled, your subscription will remain active until the end of the current billing period

3. Billing

You will be charged automatically on the renewal date unless you have canceled as specified above. You authorize us to charge the payment method on file for all renewal fees. If a charge is declined, we will notify you by email and may retry the charge during a 7-day grace period. If payment is not received within that window, we may suspend or terminate the subscription.

4. Price Changes

We reserve the right to modify subscription pricing with at least 30 days' notice sent by email to the address on file. If you do not cancel before the renewal date, you accept the new pricing.

5. Refunds

No refunds are provided for partial billing periods. If you cancel mid-period, you retain access until the end of the current billing cycle.

General Terms

1. Governing Law & Venue

These terms are governed by the laws of the State of Kansas, without regard to conflict-of-laws rules. Exclusive venue for any dispute lies in the state or federal courts located in Leavenworth County, Kansas. Each party bears its own costs and attorneys' fees unless otherwise awarded by the court.

2. Updates to These Terms

We may update these terms from time to time. Material changes will be posted on this page and communicated to active subscribers by email at least 30 days before taking effect. Continued use of the services after the effective date constitutes acceptance of the updated terms.
